Floyd Spencer LLC - Terms of Service
Last Updated: August 13, 2025
Welcome to Floyd Spencer's Career GPS! We're excited to help you on your career journey. These Terms of Service are the rules of the road for using our AI career coach. We’ve tried to make them as clear as possible.
By using our services, you’re agreeing to these terms.
The Short Version (The Gist)
We know legal documents can be a drag. Here’s the most important stuff in plain English:
-
Our AI is a tool, not a human. It provides automated suggestions. It can make mistakes, so you should always review and edit its work before you use it.
-
We can't guarantee you a job. Our goal is to give you powerful tools, but the outcome of your job search is ultimately up to you.
-
You own the personal data you give us. We just need a license to use it to power the service and (anonymously) to make our AI smarter.
-
You are responsible for your account and the final version of your resume, cover letter, etc.
-
Our financial liability is limited. This is a standard practice for online services.
-
These are the rules. If you use our service, you're agreeing to them.
1. What Our Service Does
Our service is an AI-powered platform designed to be your digital career assistant. It can help you with things like:
Think of us as a powerful tool to assist you, not as a human career coach who gives personalized, professional advice.
2. A Quick Reality Check About AI
Artificial Intelligence is an amazing technology, but it has its limits. It's important you understand that:
-
It’s Automated: All the advice and content you receive is generated by our AI without a human checking it first.
-
It’s Not Perfect: The AI might sometimes generate information that is inaccurate, incomplete, or just sounds a bit odd. You are responsible for double-checking, editing, and owning the final product.
-
NO JOB GUARANTEE: We're cheering for you, but we cannot and do not guarantee that using our service will result in a job interview, a job offer, or any other career outcome.
3. Your Account and Responsibilities
Who Can Use It: You must be at least 18 years old to create an account.
-
Be Truthful: Please provide accurate and current information when you sign up. The quality of the AI's suggestions depends on the quality of the information you provide.
-
Keep It Safe: You're responsible for your password and everything that happens on your account. If you think someone has used your account without permission, let us know right away.
4. Payments, Subscriptions, and Refunds
- How Payments Work: Some features require a payment. We'll always show you the price upfront. We use trusted third-party payment processors (like Stripe or PayPal) to handle transactions securely.
-
Subscriptions: If you sign up for a subscription, it will renew automatically (e.g., every month or year). You can easily cancel anytime from your account settings, and your subscription will end after your current paid period is over.
-
Refunds: Generally, payments are non-refundable. Please see our Terms & Conditions for details.
5. Your Content & Our Use of It
-
You Own Your Stuff: You keep 100% ownership of the personal information and resume data you upload ("User Content").
-
Our Permission to Use It: To make the service work, you give us permission (a legal license) to use your User Content. We'll only use it to provide and improve the service for you.
-
Making the AI Smarter: We may use your User Content in an anonymous, grouped-together format to help train our AI models. This helps us improve the service for everyone and will never be tied back to you personally.
6. Our Property & Your Use of It
-
We Own Our Service: We own the platform, software, AI models, and our brand.
-
You Can Use the Output: You have our permission to use the resumes, cover letters, and other content the AI generates for you for your personal job search. You just can't resell our service or its output to others.
The More "Legal" Stuff (Still Important!)
The sections below are more formal, as they need to be to be legally effective.
7. Our Service is Provided "As Is"
This means we can't promise our service will be perfect, uninterrupted, or always available. We provide the service without any express or implied warranties or guarantees. You use it at your own risk.
8. The Limits of Our Financial Responsibility (Limitation of Liability)
This is a standard part of online agreements. If something goes wrong, our financial responsibility is limited.
TO THE FULLEST EXTENT PERMITTED BY LAW, FLOYD SPENCER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT DAMAGES (LIKE LOST PROFITS OR OPPORTUNITIES). OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE LAST 6 MONTHS, OR $100, WHICHEVER IS GREATER.
9. Your Responsibility to Us (Indemnification)
If you do something while using the service that gets us sued (for example, you upload copyrighted material that isn't yours), you agree to cover our legal costs and any damages.
10. Handling Disagreements
We hope we never have a dispute, but if we do, we agree to handle it through binding arbitration in Katy, Texas, under the laws of Texas. Arbitration is a less formal process than court. This also means we both agree to waive our rights to a jury trial or to participate in a class-action lawsuit.
11. Final Details
-
Changes: We may update these terms from time to time. If we do, we'll post the new version and update the date at the top. Continuing to use the service means you accept the new terms.
